Delegate Foster moves to amend the bill on page 34, section two, line 20, by striking all of subsection (b) in its entirety and inserting in lieu thereof the following new subsection (b):

“(b) Limiting patients and caregiver rights in this chapter to only those rights that do not interfere with other citizens’ rights. –

(1) This chapter does not limit the ability of an employer to establish, continue, or enforce a drug-free workplace program or policy.

(2) This chapter does not require an employer to accommodate the medical use of marijuana.

(3) This chapter does not require an employer to allow an employee to work under the influence of medical marijuana.

(4) This chapter does not create a cause of action against an employer for wrongful discharge or discrimination.

(5) This chapter does not impair the ability of any owner, tenant, or the agent of such owner or tenant to restrict or prohibit the use of medical marijuana on his or her private property.

(6) This chapter does not require an employer to commit any act that would put the employer or any person acting on its behalf in violation of federal law.
